Occupational Safety and Health Act of 1970, Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, including severe burns, in that employees were exposed to molten process material: a) 4 Kettle Esters Process - On or about February 13, 2016, the employer failed to implement procedures to prevent employee exposure to molten 12-hydroxystearic acid released through opened manually operated drain valves. Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1904.39(a)(2): Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. a) Croda, Inc., 315 Cherry Ln, New Castle, DE - The employer failed to report the hospitalization of an employee who sustained thermal burns from molten 12-hydroxystearic acid on February 13, 2016. A report of this incident was not received by OSHA until March 3, 2016.
