29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  On or about March 8, 2016, the employer failed to establish, implement and train both authorized and affected employees on the Control of Hazardous Energy for the mold machines which are located in the rear of the main facility.  An employee last performed Lock Out Tag Out on the larger rear mold machine approximately two weeks earlier.

29 CFR 1910.157(g)(2): The educational program to familiarize employees with the general principles of fire extinguisher use and the hazards involved with incipient stage fire fighting was not provided to all employees upon initial employment, and at least annually thereafter:  Note:  Applies where all employees are expected to fight fires:    On or about March 8, 2016, the employer did not provide training to employees who work in the warehouse/main facility on fire extinguisher use for incipient stage fires on an annual basis where employees are expected and approved to use fire extinguishers.      a)  Note the employer may exercise one of the following options:     1. Provide portable fire extinguishers as specified in 29 CFR 1910.157(c)(1), meet the distribution requirements per 29 CFR 1910.157(d) (75 to the nearest extinguisher for Class A fires and 50 to the nearest unit for Class B fires), and provide training and education for all employees in the use of such equipment and the hazards associated with incipient stage fire fighting as specified in 29 CFR 1910.157(g).  The other sections of 29 CFR also apply.     2. Provide extinguishers as specified in 29 CFR 1910.157(c)(1), designate certain employees to be the only employees authorized to use such equipment and require all other employees to immediately evacuate upon the sound of the fire alarm, establish this in writing in an emergency action plan as outlined in 29 CFR 1910.38(a) and train/educate designated employees per 1910.157(g).  Utilizing this option exempts the employer from distribution requirements of 29 CFR 1910.157(d).     3. Establish a written fire safety policy which requires the immediate and total evacuation of employees from the workplace upon the sounding of a fire alarm signal.  This policy shall include an emergency action plan and a fire prevention plan as specified in 29 CFR 1910.38(a) and 29 CFR 1910.39(a).  Utilizing this option exempts the employer from the requirements of 29 CFR 1910.157 to include the need for providing portable fire equipment unless a specific standard requires that a portable fire extinguisher be provided (such as those requirements in 29 CFR 1910.106/107 related to the use/storage of flammable/combustible liquids).  If extinguishers are provided, but not intended for employee use, 29 CFR 1910.157(e) and (f) are still applicable (inspection, maintenance, and testing of equipment).    On or about March 8, 2016, the employer failed to provide training for employees on the safe use of a portable fire extinguisher where the employees are allowed to use them in all parts of the facility in the event of an incipient stage fire.

29 CFR 1910.217(c)(1)(i): The employer did not provide and ensure the usage of point of operation guards or properly applied point of operation devices on every operation performed on mechanical power press(es):   a.  On or about March 8, 2016, the employer failed to provide effective guarding at the point of operation on the pin/blade section of the mechanical power press.  The guard that was in place had an  opening measurement of over 1.5 inches.  b.  On or about March 8, 2016, the employer failed to provide guarding at the point of operation on the splice/strip section of the mechanical power press.

29 CFR 1910.303(b)(1)(ii): Electrical equipment was not free from recognized hazards, based on the mechanical strength and durability, including, for parts designed to enclose and protect other equipment, the adequacy of the protection thus provided:  On or about March 8, 2016, the employer failed to ensure that unused circuit breaker openings within the  main electrical panel box where adequately covered.  There are 4 circuit breakers that were not covered (#2, 5, 37 and 42).

29 CFR 1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling:    On or about March 8, 2016, the employer failed to provide for appropriately rated circuit breakers to be used for managing the facility lights by using the breaker switches to turn on and off the lighting in the facility.  The main electrical panel box currently indicates there are approximately ten switches assigned and being used to turn the lights on and off in the main facility.  Of these switches, none are rated for this purpose and there was no main power on/off switch.

29 CFR 1910.303(e): Markings were not provided on electrical equipment giving voltage, current, wattage, and other ratings as necessary:    On or about March 8, 2016, the employer failed to properly label the main electrical panel box, located in the main facility adjacent to the employee lunch room, with the proper voltage, wattage or other identifying marks.  The main electrical box is opened daily so that the facility lights can be turned on and off.  The employer states this box is about 240 volts.

29 CFR 1904.4(a):  A record (OSHA 300 or equivalent) of all work-related fatalities, injuries and illnesses was not maintained:    On or about March 8, 2016, the employer failed to maintain the OSHA 300 and 300A logs for their facility:    (a)  The employer did not maintain an OSHA log for calendar year 2011.  (b)  The employer did not maintain an OSHA log for calendar year 2012.  (c)  The employer combined entries on the calendar year 2013 log for incidents that occurred in the year 2013, 2014 and 2015.  To include a 2015 injury that was recorded as a lesser injury than what was sustained.    All OSHA logs above had logging issues such as but not limited too, lack of mechanism of injury, columns not totaled and blank 300A logs.
