29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:    (a)  Jagger Enterprises, Inc., DBA Jagger Roofing at 4931-4935 Valentia St., Denver, CO 80238:  On or about March 03, 2016, the exposing employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a "competent" person. Employees of Jagger Roofing were installing composite shingles on the roof of a new multi family residential building without adequate fall protection. This condition exposed employees to a fall hazard of approximately 30 feet.    Abatement Note: OSHA defines a "competent" person as someone capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest systems:    (a)  Jagger Enterprises, Inc. DBA Jagger Roofing at 4931-4935 Valentia St., Denver, CO 80238:  On or about March 03, 2016, the exposing employer did not ensure employees installing new roof shingles on a multi family residence were protected from falls. The employer did not ensure fall protection systems were provided and used. This condition exposed employees to a fall hazard of approximately 30 feet to the ground below.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a)  Jagger Enterprises, Inc., DBA Jagger Roofing, at 4931-4935 Valentia Street, Denver, CO  80238:  The employer did not ensure fall protection training was provided by a "competent" person prior to permitting employees to install new shingles on a three story multi family residence. As a result, employees were exposed to a fall hazard of approximately 30 feet to the ground below.
