29 CFR 1910.95(g)(5)(i): The employer did not establish, within 6 months of an employee's first exposure at or above the action level, a valid baseline audiogram against which subsequent audiograms can be compared:    a) Phoenix Technologies International, LLC. located in Bowling Green; On or about April 28, 2016 the employer did not maintain an audiometric testing program for all employees whose exposures equal or exceed an 8-hour time weighted average of 85 dBA. Personal noise monitoring by OSHA revealed that employees working near the dust collectors and driving forklifts were exposed to eight hour time weighted average for noise levels greater than 85 decibels.

29 CFR 1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k). The employer did not institute a training program and ensure employee participation in the program:    a) Phoenix Technologies International, LLC. Bowling Green, Ohio: On or about April 28, 2016, the employer failed to ensure that employees exposed to occupational noise received training on the effects of noise on hearing; the purpose of hearing protectors, the advantages, disadvantages, and attenuation of various types, and instructions on selection, fitting, use, and care; and the purpose of audiometric testing, and an explanation of the test procedures. Employees were exposed to noise above the 8-hour time weighted average of 85 decibels.
