29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:     On or about March 14, 2016, at the above addressed jobsite, the employer failed to maintain, implement, and develop a written hazard communication program. Employees were exposed to eye, skin contact and respiratory tract chemical hazards associated with chemicals, such as but not limited to silica dust and Portland cement.     Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:     On or about March 14, 2016, at the above addressed jobsite, employees performing masonry and bricklaying work were not trained on the hazards of working with masonry cement. Employees were exposed to eye, skin contact and respiratory tract chemical hazards associated with chemicals such as, but not limited to silica dust and Portland cement.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access:    Employees performing masonry work on the exterior of a commercial building from fabricated frame scaffolding were not provided with a safe means of access, exposing the employees to fall hazards of approximately ten (10) feet.    Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    Employees performing masonry work from fabricated frame scaffold, ten (10) feet eight (8) inches above the ground, were exposed to injuries from falls.      Marecki Masonry, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1), which was contained in OSHA inspection number 987941, citation number 1, item number 2b and was affirmed as a final order on October 8, 2014, with respect to a workplace located at 421 Madison Ave., Glencoe, IL 60022.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
