OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential falling hazards due to modified working surfaces.  a) Shredder/Baler Room - on or about March 22, 2016, employees were using a mobile ladder stand to access the power control for the Cresswood baler, but the employees had used a concrete masonry block placed on the top step of the mobile ladder platform to obtain additional height, exposing employees to falling hazards.  Among other methods, one feasible and acceptable method to correct this hazard, is to ensure additional height is not gained by the addition of any type extension or object being placed on the mobile ladder stand in accordance with the American National Standards Institute (ANSI) A14.7, Section 6.7 which states, "Additional height shall not be gained by the addition of any type extension or an object being placed on the unit".

OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees in that employees were operating a forklift without using a seatbelt which exposed employees to potential crushing hazards:    a) Shredder/Baler Room - on or about March 22, 2016, employees operated a Caterpillar Model 2EC25 forklift, but the employer did not require employees to use the installed seatbelt during operations, exposing employees to crushing hazards in the event the operator were to become unseated.    Among other methods, one feasible and acceptable method to correct these hazards, are to utilize the installed restraint system in accordance with the current version of American National Standards Institute (ANSI) B56.1, "Safety Standard for Low Lift and High Lift Trucks", Section 7.41 which states, "Counterbalanced, center control, high lift trucks that have a sit-down, nonelevating operator position shall have a restraint device, system, or enclosure that is intended to assist the operator in reducing the risk of entrapment of the operators head and/or torso between the truck and ground in the event of a tip-over".

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    a) Shredder/Baler Room - on or about March 22, 2016, the Cresswood Baler was not provided guarding to protect employees from going under the cart lifting system when in operation.    b) Shredder/Baler Room - on or about March 22, 2016, the Cresswood Baler was not provided adequate guarding to protect the operator from body parts being caught between the cart and baler opening when accessing the power control.
