29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: A). On or about 03/16/16, at the site of 42-17 157th Street. Flushing, NY Employees demolishing chimney on a pitch roof were in danger of head injury from falling objects such as, but not limited to tools and roof materials from the roof. The employees working on the ground were not provided with protective helmets. ABATEMENT VERIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) On or about 03/17/16, at the site of 42-17 157th Street. Flushing, NY Employees demolishing a chimney on a pitch roof were exposed to the hazard of falling approximately 30 ft. to the ground below. SERIOUS VIOLATION: Barmor Rehab Inc. was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent 29 CFR 1926.501(b)(13) which was contained in OSHA Inspection No. 1109646, Citation #1, Item #2b, issued on 01/05/2016 and was affirmed as a Final Order on 02/23/2016, with respect to a workplace located at 206-48 45th Road, Bayside. NY. ABATEMENT VERIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19.
