29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: (Construction Reference 1926.103) (a) Building 8544 West End Stairwell - The employer had not provided Respiratory Protection Appendix D information to workers permitted to wear North 7700 model half-face tightfitting respirators with cartridges while conducting prepping and painting operations, on or about April 15, 2016. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet.

29 CFR 1910.134(g)(1)(i)(A): Employer allowed respirators with tight-fitting facepieces to be worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function: (a) Building 8544 West End Stairwell - A laborer, observed having a full beard, was permitted to wear a North 7700 model half-face tight-fitting respirator while conducting painting operations, on or about April 15, 2016. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet.
