OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to a struck by hazard when using a lifting device that was unmarked/not rated:    On or about March 18, 2016, the employer did not ensure safe construction with proper identification, certification and labeling of the under the hook lifting device that was in use for transported coils of steel that range in weight from 7,000 to 9,000 pounds.

Bridgeport drill press, Millport drill press and American radial arm drill press.  b. Hyd- Mech horizontal bandsaw metal chip auger.  c. Peddinghaus ironworker shear, hole punch, angle cutter, square and round stock cutters.  d. Pacific hydraulic press brake, two Cincinnati and one Engel mechanical powered press brakes. Additionally the treadle/foot pedals for the two Cincinnati press brakes were not guarded against unintentional activation.

29 CFR 1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling:     On or about March 22, 2016, employees were exposed to an electrical junction knockout box that was attached to an electrical flexible cord. The flexible cord was hanging on the building column behind the American radial arm drill press.        NOTE: Knockout boxes were designed to be secured to a fixed/permanent structure. When knockout boxes are used on the ends of flexible cords, employees gripping the box to attach or disconnect a plug may dislodge the circular scored metal portion in the box wall causing it to come in contact with the hot terminal. The result may lead to an electric shock.
