29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On March 21, 2016 located on the north side of a residential structure, employees working for Castillo Roofing, LLC were observed installing roofing materials on a steep pitch roof without utilizing a fall protection system. Employees were exposed to potential fall hazards and regular and frequent inspections by a competent person were not conducted to ensure that the job-site, materials, and equipment such as fall protection were maintained and utilized in a safe manner. The Castillo Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 315712984, citation number 1, item number 1 and was affirmed as a final order on 8/23/2011, with respect to a workplace located at 6962 Francis Dr., Liberty Township, OH 45044. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems. On March 21, 2016 located on the north side of a residential structure, employees working for Castillo Roofing, LLC were observed installing roofing materials on a steep pitch roof while not utilizing any fall protection system. Potential fall height was measured in excess of 12' with a roof pitch of 6 in 12 and 10 in 12. The Castillo Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 900247, citation number 1, item number 1 and was affirmed as a final order on 07/03/13, with respect to a workplace located at 2069 Prarie Clover Dr., Lebanon, OH 45036.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. On March 21, 2016 located on the north side of a residential structure, an employee was observed utilizing a rock climbers belt while installing roofing materials on a steep pitch roof and exposed to a fall hazard. The employer did not provide training to the employees to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
