29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace: a) On or about 3/09/16 at a Condominium Construction site at 769 Legacy Dr., Lewiston, NY: An Employee was operating a rough terrain forklift truck that was lifting and supporting a wooden homemade platform with two employees working in it. The platform was elevated approx. 26 ft. above the ground and fell off the forks to the ground injuring two employees. This operator was not trained in the operation of this type of vehicle, nor was his performance evaluated in the workplace, and he was not certified as being trained and evaluated. b) On or about 3/22/16 at a Condominium Construction site at 769 Legacy Dr., Lewiston, NY: An Employee was operating a rough terrain forklift truck that was transporting wooden 2x10s on its forks. The operator was not trained in the operation of this type of vehicle, nor was his performance evaluated in the workplace, and he was not certified as being trained and evaluated. ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1926.501(b)(15): Each employee on a walking/working surface 6 feet (1.8 meters) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system: a) On or about 3/09/16 at a Condominium Construction site at 769 Legacy Dr., Lewiston, NY: A wooden homemade platform with two employees working in it was on the forks of a rough terrain forklift truck and elevated approx. 26 ft. above the ground. The platform fell off the forks to the ground injuring the two employees. No guardrails or other fall protection system was in place to protect the employees working in the platform. Additionally, there were no slots to enclose the forks at the bottom of the platform to ensure that the platform was centered when elevated, and the platform was not chained to the mast of the forklift truck to prevent it from falling off the forks. ABATEMENT DOCUMENTATION REQUIRED
