29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    A)    Berry Plastics Corporation, located at 311 West Monroe Street, Monroeville, OH 44847: On or about February 25, 2016, the employer failed to provide proper training in stand-up forklift operations to ensure that employees, operating stand-up powered industrial vehicles such as, but not limited to, the Toyota stand-up forklift (Model 8DR 8BDRU15, Serial # 8BDRU1536680), were competent to safely complete the task. The training shall consist of a combination of formal instructions, practical training, and evaluation of the operators performance in the workplace. Employees were exposed to struck-by, caught-in-between, and tip-over hazards.

29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not conducted as required by paragraph (l)(4)(ii) when the operator had been involved in an accident or near-miss incident to ensure that the operator had the knowledge and skills needed to operate the powered industrial truck safely:     A)    Berry Plastics Corporation, located at 311 West Monroe Street, Monroeville, OH 44847: On or about March 10, 2016, the employer failed to provide refresher training in safe operation of stand-up powered industrial vehicles for the employee who was involved in an incident/near miss while driving one of the stand-up Crown forklifts in the mold department. The operator hit safety bumper located overhead on the North side of the mold department. Employees were exposed to struck-by hazards due to the lack of refresher training.
