29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.    a. On or before March 24, 2016 where employees were working below employees who were setting trusses, head protection was not used, thereby exposing the employees to a struck-by hazard.

29 CFR 1926.102(a)(1): Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents.    a. On or before March 24, 2016, where employees were using air actuated nail guns to secure trusses to the top plate, eye protection was not used, thereby exposing employees to struck-by hazards.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.     a. On or before March 24, 2016, the employer did not require the use of any form of fall protection during framing and roof sheeting work. This violation was most recently observed at Asherton Grove Drive, Building 15, Westerville, Ohio, 43018, where 7 employees were not protected from fall hazards of 9 feet, 4 inches to the ground.       To abate this violation, the employer must ensure that its employees are protected from falls, and that no employee is allowed at heights of more than six feet high without adequate fall protection.    E.T Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1114739, citation number 1, item number 1 and was affirmed as a final order on March 15, 2016, with respect to a workplace located at Lot 97, Antler Trail, Medina, Ohio, 44256.     E.T Construction was previously cited for a Willful violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 7122238, citation number 1, item number 1 and was affirmed as a final order on May 1, 2013, with respect to a workplace located at 1201 North Main Street, Orrville, Ohio, 44667.  Pursuant to 29 C.F.R 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards.
