29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person.  On or about March 23, 2016, inexperienced and untrained employees erected scaffolding to lay brick for the condominiums under construction and the erection of the scaffold was not supervised by a competent person, exposing employees to a fall hazard.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms.  On or about March 23, 2016, employees were laying brick from the tubular welded scaffolding to the condominiums under construction up to approximately 24 feet high and did not have guard rails along all open sides, exposing employees to a fall hazard.

29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.  On or about March 23, 2016, employees were exposed to falling objects from approximately 24 feet high while working from a tubular welded-frame scaffold that did not have toe boards or other devices used to prevent falling tools, materials and debris, exposing employees to the hazards of being struck by materials.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  On or about March 23, 2016, the foreman and employees were working from the tubular welded scaffolding at approximately 24 feet high without being trained to recognize the hazards of working from scaffolding, exposing employees to a fall hazard.  Note: The training shall include the following areas, as applicable: a)  Any electrical hazards, fall hazards and falling object hazards in the work area; b)  The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used; c)  The proper use of the scaffold, and the proper handling of materials on the scaffold; d)  The maximum intended load and load-carrying capacities of the scaffolds used; and e)  Any other pertinent requirements of this subpart.

29 CFR 1926.454(b): The employer did not have each employee who was involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question.  On or about March 23, 2016, the foreman and employees were working from the tubular welded scaffolding at approximately 24 feet high. The erection of the scaffold was not supervised by a competent person and the workers were not trained in scaffold erection, exposing employees to a fall hazard.  The training shall include the following topics, as applicable: a)  The nature of scaffold hazards; b)  The correct procedures for erecting, disassembling, moving, operating, repairing, inspecting, and maintaining the type of scaffold in question; c)  The design criteria, maximum intended load-carrying capacity and intended use of the scaffold; d)  Any other pertinent requirements of this subpart.
