29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  (a) Brickmont Assisted Living, north exterior wall: On or about March 29, 2016, and at times prior, the employer failed to provide protective eyewear to employees operating pneumatic nail guns operating at 120 PSI. Employees were exposed to struck-by hazards which included plastic debris and fasteners as safety glasses or other eye protection was not provided.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:  (a) Brickmont Assisted Living, north side exterior wall: On or about March 29, 2016, and at times prior, The employer exposed employees to fall hazards of 18-feet, 3-inches from the ladder jack scaffold platform, in that a Mid rails and end rails was not provided while employees were installing siding.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a)  Brickmont Assisted Living, rear roof dormer: On or about March 29, 2016, and at times prior, the employer exposed employees to fall hazards of 21-feet, 6-inches working from a 6/12 pitched roof, in that personal fall arrests were not provided to employees while installing siding.  (b) Brickmont Assisted Living, north side roof dormer: On or about March 29, 2016, and at times prior, the employer exposed employees to fall hazards of 21-feet, 6-inches working from a 6/12 pitched roof, in that personal fall arrests were not provided to employees while installing siding.
