29 CFR 1910.1025(d)(2): An initial determination was not made to determine if any employee may be exposed to lead at or above the action level:  a) Worksite--Sgt. James J. Shea Memorial Pistol Range, Bayonne, NJ  The employer did not initially determine worker exposure to lead for employees conducting firearms training.  Lead contamination was found within the facility to include, on 3/30/16, 1,700 micrograms (ug) on the microwave panel and top of door, 1,300 ug/ft2 on the floor by the bathroom, 830 ug/ft2 on the table by the sink and microwave, 790 ug/ft2 on a yellow molded chair and 220 ug/ft2 on a table by the vending machine.  On 4/4/16 there was 5,300 ug/ft2 on the carpet by the door to the firing range, 2,900 ug/ft2 on the HEPA filter vacuum stored by the vending machine, 2,400 ug/ft2 on the check in counter, 1,400 ug/ft2 on the seat of a gray chair.   In addition, an employee experienced an elevated blood lead level.    Violation occurred on or about 3/30/16.  New Jersey Firearms Academy, Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1025(d)(2), which was contained in OSHA inspection number 1049629, citation number 1, item number 1 and was affirmed as a final order on 7/14/15, with respect to a workplace located at Schuetzen Park, Inc. firing range, 3167 Kennedy Blvd. North Bergen, NJ.

Shea Memorial Pistol Range, Bayonne, NJ  New Jersey Firearms Academy provided no medical surveillance for employees exposed to lead.  An employee learned from his own pediatrician that he had an elevated blood lead level had to seek retesting and treatment at his own expense.  Lead contamination was found throughout the Sgt. James J. Shea Memorial Pistol Range to include: on 3/30/16, 1,700 micrograms (ug) on the microwave panel and top of door, 1,300 ug/ft2 on the floor by the bathroom, 830 ug/ft2 on the table by the sink and microwave, 790 ug/ft2 on a yellow molded chair and 220 ug/ft2 on a table by the vending machine.
