29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders were not used at an angle such than the horizontal distance from the top support to the foot of the ladder way approximately one-quarter of the working length of the ladder:    a)  Gardens @ 21, 105 Commodore Blvd., Jackson, NJ: On or about 3/29/2016 employees of AA&B Builder were using an aluminum extension ladder to access an upper level.  The ladder was erected at a shallow angle, exposing the employees to a potential fall hazard.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired    a)  Gardens @ 21, 105 Commodore Blvd., Jackson, NJ: On or about 3/29/2016 employees of AA&B Builder were using an aluminum extension ladder to access an upper level.  The ladder was found to have a damaged rung, exposing the employees to a potential fall hazard.

29 CFR 1926.1053(b)(22): Employees  using ladders were carrying objects or loads that could cause the employee to lose balance and fall:    a)  Gardens @ 21, 105 Commodore Blvd., Jackson, NJ: On or about 3/29/2016 employees of AA&B Builder were using an aluminum extension ladder to access an upper level.  An employee that was using the ladder while carrying one end of a scaffold pic.  The employee lost his balance and fell to the ground below.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards.     a)  Gardens @ 21, 105 Commodore Blvd., Jackson, NJ: On or about 3/29/2016 employees of AA&B Builder were using an aluminum extension ladder to access an upper level.  Employees were carrying materials while climbing and the ladder was found to have a damaged rung and was erected at a shallow angle, exposing them to fall hazards.  The employer did not provide each employee training on using ladders that would enable them to recognize and minimize hazards.     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
