29 CFR 1910.132(d)(1)(i): The employer did not select and have each affected employee use, the types of personal protective equipment that would protect the affected employee(s) from the hazards identified in the hazard assessment: A. On or about March 30, 2016, in the tall oil plant, employees gathering hot liquid samples were exposed to thermal burns in that the employer selected Nomex flash hoods to protect employees from splash hazards to their neck and heads from hot liquid tall oil distillates instead of a liquid-impermeable hood garment.

29 CFR 1910.132(e): The employer did not remove from service defective or damaged personal protective equipment. a. On or about March 30, 2016, on the third level of the tall oil plant, at the dark rosin bottom sample station, the sampling shield barrier was damaged in that it was missing the upper panel, exposing employees to the hazard of being sprayed by hot liquid rosin.

29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: a. On or about March 30, 2016, in the Tall Oil Plant, Tall Oil Operators and Assistant Operators did not wear appropriate protective eyewear while taking samples, in that they did not wear protective goggles to prevent injury from splashing hot liquid tall oil distillates samples as specified in ANSI Z87.1, American National Standard Practice for Occupational and Educational Eye and Face Protection.
