29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): On or about April 01, 2016, employees engaged in maintenance activities on the sludge press and dryer equipment and other equipment throughout the facility were exposed to physical and chemical hazards associated with the sludge and press and other equipment and the employer had not assessed the maintenance tasks to determine the hazards and appropriate personal protective equipment for maintenance personnel protection.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: On or about April 01, 2016, employees engaged in operation and maintenance activities on the sludge press/dryer equipment and other equipment throughout the facility were exposed to physical and chemical hazards associated with the plating sludge and the employer had not evaluated the respiratory hazards posed by the chemicals in the sludge that included a reasonable estimate of employee exposures during operation and maintenance tasks, including the identification of the physical form and chemical state of the contaminants present.
