29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, and indications of failure of protective systems: (a) A competent person did not inspect the jobsite to ensure that the proper protective systems were available onsite. This exposed employees working in the excavation to a trench collapse hazard.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c): (a) The employer did not ensure that an employee(s) in an approximately 8 1/2 foot deep trench were protected from cave-ins with an adequate protective system. This exposed employees to struck by, engulfment and crushing hazards from a trench collapse. The MJ Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number #1045871, citation number two, item number one and was affirmed as a final order on July 24, 2015, with respect to a workplace located at S. 27th St. between W. Drexel Ave. & W. Rawson Ave. in Oak Creek, WI.
