29 CFR 1910.134(k): The employer did not provide the basic information on respirators in accordance to Appendix D of this section to employees who wear respirators when not required by this section or by the employer to do so: On or about April 05, 2016, and times prior to, the employer did not ensure that employees voluntarily using 3M 8200 N95 Particulate Filtering Face pieces respirators were provided a copy of Appendix D. Employees were potentially exposed to respiratory hazards when performing tasks such as, but not limited to repairing concrete forms.
