29 CFR 1926.451(e)(9)(i): The employer shall provide safe means of access for each employee erecting or dismantling a scaffold where the provision of safe access is feasible and does not create a greater hazard. The employer shall have a competent person determine whether it is feasible or would pose a greater hazard to provide, and have employees use a safe means of access. This determination shall be based on site conditions and the type of scaffold being erected or dismantled. a. On or about April 12, 2016, at the above addressed jobsite, employees erecting a scaffold were exposed to fall hazards when a safe means of access was not provided to the scaffold during the erection process.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a. On or about April 12, 2016, at the above addressed jobsite, employees performing stucco operations from the roof were exposed to falls, of fourteen (14') feet eight (8") inches, created by the presence of unprotected sides.
