29 CFR 1910.178(l)(1)(i): Operators were not trained in the safe operation of powered industrial trucks as demonstrated by the successful completion of the training and evaluation specified in this paragraph(1): (a) On or about 4/4/2016 - Returnable Container Center (RCC), a new temporary employee did not receive an evaluation on the operation of an electric pallet jack and was subsequently injured in a struck-by incident when she walked out from behind a stack of totes and into the path of an oncoming powered industrial truck.

29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: (a) On or about 04/04/2016 - Returnable Container Center (RCC), a Yale Powered Industrial Truck, Model #ERC050VGN36TE085, Serial #A968N13478N, involved in a struck-by incident with injury was found to have worn tires in a post-struck-by inspection conducted by the manufacturer's technician.
