29 CFR 1910.23(a)(2): Every ladderway floor opening or platform was not guarded by a standard railing with standard toeboard on all exposed sides (except at entrance to opening), with the passage through the railing either provided with a swinging gate or so offset that a person cannot walk directly into the opening: a) International Waxes, Inc. in Smethport, PA, platform between the fixed ladders to the top of the fly-ash silo. On or about April 15, 2016, the opening to the lower ladder from the landing platform was not guarded by a swinging gate or offset to prevent employees from stepping directly into it. The condition exposed personnel to a fall hazard of at least 20-feet from the platform to the ground.

29 CFR 1910.27(d)(2)(ii): All landing platforms were less than 24 inches in width and 30 inches in length: a) International Waxes, Inc. in Smethport, PA, platform between the fixed ladders to the top of the fly-ash silo,. On or about April 15, 2016, the landing platform of the fixed ladder to the top of the fly-ash silo was approximately 10 inches wide. The condition exposed personnel to a fall hazard of at least 20-feet from the platform to the ground.

29 CFR 1910.37(a)(4): Safeguards designed to protect employees during an emergency were not in proper working order at all times: a) 3rd floor of MEK Unit, International Waxes, Inc. in Smethport, PA. On or about April 15, 2016, the exit door was not in proper working order in that, the door did not open fully due to an exterior, low-hanging pipe directly behind the door. The door could open only 9 inches because of the pipe.
