29 CFR 1926.1053(b)(15):  Ladders were not inspected by a competent person for visible defects on a periodic basis and after any occurrence that could affect their safe use.    (a)Diablos Construction, Inc. @ 912 Confidence Drive, Longmont, Colorado 80504. On or before February 23, as part of the injury/accident prevention responsibilities under its safety program, the exposing employer did not ensure that the metal ladder employees used to gain access to the roof to perform siding activities, was inspected by a competent person for visible defects and deficiencies such as, but not limited to the following:  1)  The ladder was not secured to prevent accidental displacement when used on surfaces which were not stable and slippery with snow;  2) The ladder was not used at designed by the manufacturer. One section of the ladder had been removed parted as single section lessening its load capacity;  3)  The top section was not extended at least 3 feet or secured at the roof top. This condition exposed employees to the hazard of falling approximately 10 feet to the lower roof level. On February 23, 2016 an employee was carrying an air compressor while ascending the ladder, and fell approximately 10 feet to the lower roof level resulting in a knee injury.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary. The program did not enable each employee to recognize hazards related to ladders and stairways, and did not train each employee in the procedures to be followed to minimize these hazards:  (a) Diablos Construction, Inc. @ 912 Confidence Drive, Longmont, Colorado 80504:  On or before February 23, as part of the injury/accident prevention responsibilities under its safety program, the exposing employer did not ensure that each employee using the metal ladder to gain access to the roof top was provided with ladder safety training as required under the standard.  This condition exposed employees to the hazard of falling approximately 10 feet to the lower roof level. On February 23, 2016 an employee was carrying an air compressor while ascending the ladder, and fell approximately 10 feet to the lower roof level resulting in a knee injury.    Abatement Note:  The employer shall ensure that each employee has been trained by a competent person in the following areas, as applicable:    (a)  The nature of fall hazards in the work area; (b)  The correct procedures for erecting, maintaining, and disassembling the fall protection systems to be used; (c)  The proper construction, use, placement, and care in handling of all stairways and ladders;  (d)  The maximum intended load-carrying capacities of ladders; and  (e)  The standards contained in this subpart.
