29 CFR 1910.1030(c)(2)(i)(B): The exposure determination did not include a list of all job classifications in which some employees have occupational exposure:  a) The employer's Blood borne Pathogens Program did not include the job classifications of Engineers, Conductors, and Locomotive/Train Car Maintenance personnel as employees which may incur occupational exposure to blood or other potentially infectious materials. Engineers and Conductors exiting the locomotive, following a pedestrian or vehicle strike, have potential occupational exposure to human blood and other potentially infectious materials. Engineers, Conductors, and Locomotive/Train Car Maintenance personnel conducting post-accident hands-on inspections and daily inspections following vehicle/pedestrian-train collisions have potential occupational exposure to human blood and other potentially infectious materials.   On March 12, 2016 the Engineer and Conductor involved in a pedestrian train strike were potentially exposed to blood and other potentially infectious material using the hand rail and stairs exiting the locomotive.    On March 12, 2016, the relief crew Conductor and Engineer identified blood and other human remains on the locomotive involved with the pedestrian train strike (after a Contractor had cleaned the locomotive), while inspecting the train to return the train back to service.

29 CFR 1910.1030(g)(2)(i): The employer did not ensure that each employee with occupational exposure participated in a training program:  a) The employer did not train Engineers, Conductors, and Locomotive/Train Car Maintenance personnel that only authorized contractors are allowed to clean up blood from their equipment and workplaces and employees are not authorized to clean up blood.  b) The employer did not train Engineers, Conductors, and Locomotive/Train Car Maintenance personnel on the procedures to be taken by employees when they observe blood and other potentially infectious material on equipment or in the workplace.  c) The employer did not train Engineers, Conductors, and Locomotive/Train Car Maintenance personnel how they would be informed the locomotive or rail car was recently involved in a vehicle or pedestrian strike and what additional precautions should be taken to prevent contact with blood and other potentially infectious material.
