29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) Worksite was located at 304 Broadway, Bayonne, NJ 07002. Employees were exposed to an improperly guarded fall hazard at stair tower 2 where a pallet had been leaned in place to act as a guardrail to protect employees from a 10 foot fall to water and concrete. Violation was observed on or about 4/19/2016. b) Worksite was located at 304 Broadway, Bayonne, NJ 07002. Employees were exposed to a fall hazard at stair tower 2 where there was no guardrail to protect employees from a 20 foot fall to water and concrete. Violation was observed on or about 4/19/2016. c) Worksite was located at 304 Broadway, Bayonne, NJ 07002. Employees were exposed to a fall hazard at stair tower 1 where there was no guardrail to protect employees from a 12 foot fall to concrete. Violation was observed on or about 4/19/2016. d) Worksite was located at 304 Broadway, Bayonne, NJ 07002. Employees were exposed to an improperly guarded fall hazard at the elevator tower where there was a guardrail to protect employees from a 17 foot fall to concrete that had a midrail that was not secured but held in place with tie wire. Violation was observed on or about 4/19/2016. e) Worksite was located at 304 Broadway, Bayonne, NJ 07002. Employees were exposed to a fall hazard at the forward leading edge of deck 1 where there was no guardrail to close off a 26 inch opening to protect employees from a 12 foot fall to concrete. Violation was observed on or about 4/19/2016.

29 CFR 1926.706(b): Masonry walls over eight feet in height were not adequately braced to prevent overturning and to prevent collapse until permanent supporting elements of the structure were in place. a) Workplace was located at 304 Broadway, Bayonne, NJ 07002. Employees were exposed to two unsupported masonry walls at least 38 feet tall that bore no braces to prevent it from collapsing. One of the two unsupported walls collapsed on the morning of 4/3/2016. Observation was made on or about 4/2/2016.
