OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with unexpected release of hazardous energy. At the workplace, an employee conducted hot tap operations on a pressurized gas pipeline and did not document, implement, and/or follow procedures to control the unexpected release of hazardous energy. This exposed an employee to struck-by and other hazards associated with a high pressure gas release.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems. At this workplace, employees conducted hot-tap operations in an excavation greater than five feet in depth, daily inspections were not conducted by a competent person to ensure the excavation protective systems were in place for employee safety. The employees were exposed to engulfment and struck-by hazards.
