29 CFR 1910.106(e)(6)(i): Adequate precautions were not taken to prevent the ignition of flammable vapors from sources such as open flames; lightning; smoking; cutting and welding; hot surfaces; frictional heat; static, electrical, and mechanical sparks; spontaneous ignition, including heat-producing chemical reactions; and radiant heat: Production Room: On April 14, 2006 flammable toluene vapors were ignited potentially by static electricity resulting in a workplace fire and burn injuries to a worker. a) The fill pipe for tank 3 was not designed and installed to minimize static electricity. Toluene was allowed to free fall into the tank. b) Workers were not provided personal protective equipment and clothing consisting of materials that would reduce the occurrence of electrostatic discharges. c) Procedures were not implemented to ensure there was adequate humidification in production room prior to pumping and mixing flammable liquids. .

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: Production Room: Flame resistant protective clothing that provides protection against flash fires was not provided to employees working with flammable liquids. On October 14, 2016 An employee suffered skin burns when his clothing caught fire after toluene vapors were ignited during tank filling operations.
