29 CFR 1926.502(d)(16)(iv): Personal fall arrest systems, when stopping a fall, did not bring an employee to a complete stop and/or and did not limit maximum deceleration distance to 3.5 feet (1.07 m):  a) 699 Route 49 East, Teterboro, NJ  Two employees were observed in roofing tasks adjacent to the edge of an overhang-type flat roof, and were exposed to an approximate 11' fall, on or about April 25, 2016. One employee was attached to a rope via a rope grab that was attached to an anchor via a simple knot. The employee was attached to the rope in a fashion that would not decelerate the employee within 3.5 feet.   There is no abatement certification or documentation required for this item.

29 CFR 1926.502(d)(21): Personal fall arrest systems were not inspected prior to each use for wear, damage, and other deterioration, and/or defective components were not removed from service:  a) 699 Route 49 East, Teterboro, NJ  Two employees were observed in roofing tasks adjacent to the edge of an overhang-type flat roof, and were exposed to an approximate 11' fall, on or about April 25, 2016. An attachment clip used by an employee was stuck open due to metal corrosion, and a fall arrest rope was in poor condition, and red strands were visible.   There is no abatement certification or documentation for this item.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    a) 699 Route 49 East, Teterboro, NJ    Two employees were observed in roofing tasks adjacent to the edge of an overhang-type flat roof, and were exposed to an approximate 11' fall, on or about April 25, 2016. Employees were not adequately trained to safely utilize fall protection equipment, as employees repeatedly approached an unprotected roof edge, and used fall protection equipment that was deteriorated and did not utilize fall protection equipment in a manner that would safely arrest a fall.     Abatement documentation is required for this item.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  a) 699 Route 49 East, Teterboro, NJ  Two employees were observed in roofing tasks adjacent to the edge of an overhang-type flat roof, and were exposed to an approximate 11' fall, on or about April 25, 2016. Employees did not utilize, or were not provided with adequate fall protection. One employee was not anchored, and one employee had an improper lanyard.   Furia Roofing Co. Inc. was previously cited for a substantially similar violation of the Occupational Safety and Health standard, or it's equivalent standard 29 CFR 1926.501(b)(10) which was contained in OSHA inspection number 459355, citation number 1, item number 1, issued on June 19, 2012, and became a final order on July 9, 2012.   There is no abatement certification or documentation for this item.
