29 CFR 1910.176(b): Material stored in tiers was not stacked, blocked, interlocked or limited in height so that it was stable and secure against sliding and collapse: a) On or about 12/29/2015, at brick/block outdoor storage area at 303 Johnson Avenue, Brooklyn, NY 11206 Masonry blocks and brick, stacked to heights of 9-12 feet or more, were not stacked and interlocked in a manner to prevent them from shifting, sliding or falling. In addition, a chemical IBC tank, similar to the ones the company attaches to a forklift and uses to spread water for dust control, was stored on top of four vertically stacked bales of bricks, with the tank partially overhanging the edge of the brick, unsupported. ABATEMENT CERTIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19

29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: a) On or about 4/27/2015, at work site at 303 Johnson Avenue, Brooklyn, NY 11206 Employer did not conduct noise monitoring where employees operate trucks, forklifts, front loaders and self-propelled sweepers. The street sweeper produced noise levels of 86-88 dBA at a distance of 4" from the cab, while an employee who spent part of his work day operating the street sweeper had a noise dose exposure of 55% or time weighted average exposure of 84.3 dBA, which exceeded the extended shift action level of 83.6 dBA. ABATEMENT CERTIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19
