29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:(  a) A laborer was cleaning residual paint/ shot blast debris from below-deck compartment(s) of the tugboat Gelberman in dry-dock #7.  He wore a 3M half-face respirator(s) with P100 HEPA filters, which was provided & required to be worn by the employer.  A medical evaluation was not provided to the worker before assignment to cleaning duties, in order to ensure that the user was medically suited to wear a respirator.  Condition(s) was noted on or about 4/28/2016.   Note:  The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.

29 CFR 1910.134(m)(1): Records of medical evaluations required by 29 CFR 1910.134 were not retained and made available in accordance with 1910.1020:  a) Records of medical approvals for fitters and welders, required to wear air-purifying respirators, were not maintained by the employer; either in electronic or hard copy form.  Failure to retain the records hinders evaluation of the respirator program by the program administrator and OSHA.     Conditions existed on and before 5/11/2016.
