Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while working from order pickers without using body belts. On May 4, 2016 the CSHO found that the employer did not ensure that employees, who were pulling stock onto elevated platforms and loading shelves, were using fall protection.

Supply New England, 582 Quaker Highway, Uxbridge, Massachusetts; On May 4, 2016 employees were working from the mezzanine and upper levels of the warehouse and were exposed to falls of approximately 10 feet to the ground below due to the lack of standard railing.     a.  Fall from the mezzanine by the loading docks - approximately 8 feet 6 inches b.  Fall from the mezzanine in the back by the battery charger - approximately 13 feet 10 inches

29 CFR 1910.37(a)(3): Exit route(s) were not kept free and unobstructed:  Supply New England, 582 Quaker Highway, Uxbridge, Massachusetts; Exits in the warehouse were blocked by equipment.  a.  Front of the warehouse by the loading dock - both the egress door and adjacent equipment door were blocked by boxes and pallets of plumbing supplies. b.  Across from the service desk, left end of the dock looking out, was blocked by pallets and boxes of plumbing supplies. c.  Rear of the warehouse by rack D032 was blocked by storage of plumbing supplies and shelving equipment.

29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not conducted as required by paragraph (l)(4)(ii) when the operator had been involved in an accident or near-miss incident to ensure that the operator had the knowledge and skills needed to operate the powered industrial truck safely.   Supply New England, Warehouse, 582 Quaker Highway, Uxbridge, Massachusetts; On May 4, 2016 powered industrial truck damage to racks in the warehouse was found.  There was no indication of driver retraining for employees involved in near misses and accidents while driving powered industrial trucks.
