OSH ACT of 1970 Section (5)(a)(1): Public Law 91-596, the Occupational Safety and Health Act of 1970, Section 5(a)(1):The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or are likely to cause death or serious physical harm to his employees, in that employees were exposed to struck-by hazards. (a) Employees supporting aerial spraying of fertilizer at Morgan Planting Company on May 7, 2016 were exposed to struck-by hazard when walking and working in close proximity to moving tractor trailer trucks, fertilizer tenders, Ford F350 flatbed dually truck and airplanes. .
