29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system. a) S. Yarmouth Ave, Longport, NJ: On or about 5/9/2016, employees of Devine Construction LLC were conducting masonry work on the chimney of a multi-story new construction residential structure. One employee was working from the roof of a second story porch, performing finishing work. The worker was not using any form of fall protection and as such, he was exposed to a fall hazard of over 25 feet to the ground below. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
