29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: The employer is failing to protect employees from electrical, caught between and amputation hazards associated with maintain equipment that requires the application of a lock or tag to isolate the hazardous stored energy. The most recent occurrence of this was evident during the inspection of the facility located at 1967 Dove Hills Ave, Kearney, NE 68845, where the employer has employees maintaining equipment without having developed a written lockout and/or tag out program as means of identifying hazards and mitigating risks. Instances of hazards and exposures include but are not limited to: i. Employees changing out the blade on the Baker Re-Saw every other production day. ii. Employees servicing the air compressor. iii. Employees performing maintenance without written specific procedures.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii) and describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: The employer is failing to protect employees from chemical hazards associated with the use of hazardous chemicals in the work place without having developed and implemented a written HAZCOM program. The most recent occurrence of this was evident during the inspection of the facility located at 1967 Dove Hills Ave, Kearney, NE 68845, where the employer has employees using different hazardous chemicals for the maintenance of their equipment without having developed and implemented a written program as means of identifying hazards and mitigating risks. Instances of hazards and exposures include but are not limited to: i. Employees using grease and oil in the maintenance of the Baker Re-Saw. ii. Employees using grease and oil in the maintenance of the air compressor. iii. Employees using grease and oil in the maintenance of the forklifts. iv. Missing chemical inventory list used to track required Safety Data Sheets.
