29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a. On or about May 19, 2016, at the above addressed jobsite, an employee was operating a powered industrial vehicle (Cat-TL 642) during material handling operations. The operator of the powered industrial truck did not complete the required training and evaluation specified in paragraph (l).

29 CFR 1926.503(c): "Retraining." When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer shall retrain each such employee. Circumstances where retraining is required include, but are not limited to, situations where: a. On or about May 19, 2016, at the above addressed jobsite, employees stacking material on a roof, with a pitch of 6:12, approximately eight (8) feet six (6) inches and eight (8) feet five (5) above the ground, were not protected from falls, thereby exposing employees to fall hazards.
