Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to crushing hazards. The employer is failing to protect employees from crushing hazards associated with working under an unstable working surface. The most recent occurrence of this was evident at the facility located at 3423 W. State Street, Grand Island, NE 68803 where the employer has employees working in the basement changing oil on vehicles that are parked over the pits and the support beams for the floor have deteriorated making the area unsafe to occupy. ONE METHOD OF FEASIBLE AND ACCEPTABLE METHODS OF ABATEMENT TO CORRECT THIS HAZARD INCLUDES BUT IS NOT LIMITED TO: a. The employer follow the guidance of the engineer report and have a contractor repair the structural damage.

29 CFR 1910.305(g)(1)(iv)(A): Flexible cords and/or cables were used as a substitute for the fixed wiring of a structure: The employer is failing to protect employees from electrical hazards associated with using temporary flexible cords. The most recent occurrence of this was evident at the facility located at 3423 W. State Street, Grand Island, NE 68803 where the employer has employees using equipment that is connected to temporary flexible cords for power. Instances of hazard and exposure include but are not limited to: i. Yellow and orange cords rand throughout the basement level to provide power for the lack of outlet boxes. ii. Orange temporary flexible cord running along the wall up the stairs from the basement to the outlet box at the top of the stairs. iii. Power strip plugged into an orange flexible cord.
