29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions: a) Joint Base Langley Eustis, Building 2308, Fort Eustis, VA 23604: On or about May 19, 2016, an employee who sprayed Portland cement with water to make mortar, was not required to wear appropriate personal protective equipment, such as goggles, as referenced by 1926.102, exposing the employee to potential eye injury. No abatement certification or documentation required.

29 CFR 1926.451(h)(2): Employees working below a scaffold were not protected from falling tools, materials or equipment in accordance with the provisions of paragraphs (h)(2)(i)-(v) of this section: a) Joint Base Langley Eustis, Building 2308, Fort Eustis, VA 23604: On or about May 19, 2016, employees and other contractor's employees were not protected from falling bricks and/or other materials from a hydro-mobile scaffold, exposing employees to struck-by hazards and injuries. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
