29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measures    a) 2201 Bay Avenue Ocean City NJ: On or about 5/19/16, Pineda Construction, Inc. employees were engaged in residential construction activities. Two employees were observed removing shingles from on the roof.  The workers were not protected by guard rails, PFAS, or any form of fall protection and were thus exposed to a fall hazard of greater than 21 feet from the ground surface below.     Pineda Construction LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 315487108, citation number 1, item number 2 and was affirmed as a final order on 7/1/11, with respect to a workplace located at 839 White Horse Pike, Egg Harbor City, NJ.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
