29 CFR 1926.502(b)(2): Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structure members were not installed between the top edge of the guardrail system and the walking/working surface when there was no wall or parapet wall at least 21 inches (53 cm) high: a) On or about 05/24/16, on the first floor inside the center section of an old building under renovation at 885 Niagara Street, Buffalo, NY: A guardrail system was used to prevent employees from falling up to 10 ft. into a rectangular hole in the floor surrounding an unsafe stairway leading down into the basement of the building. A section of the guardrail at the east end of the hole and at the south side adjacent to the east end of the hole lacked a mid-rail. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.502(b)(11): When guardrail systems are used at holes, they were not erected on all unprotected sides or edges of the hole: a) On or about 05/24/16, on the first floor inside the center section of an old building under renovation at 885 Niagara Street, Buffalo, NY: A guardrail system was used to prevent employees from falling up to 10 ft. into a rectangular hole in the floor surrounding an unsafe stairway leading down into the basement of the building. There was no guardrail installed at the west end of the hole, only a top piece of danger tape and an intermediate piece of danger tape were in place. NO ABATEMENT CERTIFICATION REQUIRED
