29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    a)  On May 25, 2016, employees working in an excavation of up to approximately 7.7 in depth were not provided a suitable means of egress.    Lampignano & Sons Construction Co. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2) which was contained in OSHA inspection number 900998, citation 2, item 1, and was affirmed final order on July 2, 2013, with respect to a workplace located at 8363 Western, Niles, IL 60714.      Lampignano & Sons Construction Co. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2) which was contained in OSHA inspection number 107815, citation 1, item 2, and was affirmed final order on November 16, 2011, with respect to a workplace located at Cleveland St. & Waukegan Rd., Niles, IL 60714.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c):        a)  On or about May 25, 2016, employees working in an excavation up to approximately 7.7 feet in depth were exposed to cave-in hazards.    Lampignano & Sons Construction Co. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA inspection number 900998, citation 2, item 2, and was affirmed final order on July 2, 2013, with respect to a workplace located at 8363 Western, Niles, IL 60714.      Lampignano & Sons Construction Co. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA inspection number 107815, citation 1, item 3, and was affirmed final order on November 16, 2011, with respect to a workplace located at Cleveland St. & Waukegan Rd., Niles, IL 60714.     No abatement certification or documentation is required for this item.
