29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:       a)  On August 24, 2017, fly section of the extension ladder used by employees to access and egress the trench was not long enough to have its side rails extended at least 3 feet above the ground.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c):       a)  On August 24, 2017, employees were not protected from the hazard of cave-in while working in a trench measuring approximately 6.3 feet in depth.    Lampignano & Son Construction Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1150176, citation number 1, item number 2 and was affirmed as a final order on August 23, 2016, with respect to a workplace located at 2700 Oakton St., Park Ridge, IL 60068.    Lampignano & Son Construction Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 900998 citation number 2, item number 2 and was affirmed as a final order on July 2, 2013, with respect to a workplace located at 8363 Western, Niles, IL 60714.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
