29 CFR 1926.602(c)(1)(ii): Modifications or additions affecting the safe operation of the equipment were  made without the manufacturer's written approval: (Note:  If such modifications or changes were made, the capacity, operation, and maintenance instruction plates, tags, or decals should have been changed accordingly.)    a) Worksite, Building #5, Southern facing exterior: Employees were working from a Lull Rough Terrain Forklift with an added job-made attachment. The forklift attachment was being used to raise and contain an employee for framing work without the manufacturer's written approval and without adjusted instruction plates, tags, or decals; on or about 5/25/16.     b) Worksite, Building #5, Western facing exterior: Employees were working from a Lull Rough Terrain Forklift with an added job-made attachment. The forklift attachment was being used to raise and contain an employee for framing work without the manufacturer's written approval and without adjusted instruction plates, tags, or decals; on or about 5/25/16.     Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    a) Worksite, Building #5: Employees working directly under ongoing framing activities were not using head protection; on or about 5/25/16.    b) Worksite, Building #4: Employees working directly under ongoing balcony work were not using head protection; on or about 5/25/16.      South Ocean Custom Framing Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.100(a), which was contained in OSHA inspection number 329484, citation number 1, item number 1 issued on 9/5/2012 and was affirmed as a final order on 9/28/2012, with respect to a worksite located at Wading River Hollow Rd/Middle Country Rd. in Middle Island, NY 11953.      Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) Worksite, Building #5: Employees doing framing work approximately 30 ft. above the ground from the edge of the third story did not have fall protection; on or about 5/25/16.    b) Worksite, Building #4: Employees doing balcony work approximately 10-11 ft. above the ground did not have fall protection; on or about 5/25/16.      South Ocean Custom Framing Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 329484, citation number 1, item number 2 issued on 9/5/2012 and was affirmed as a final order on 9/28/2012, with respect to a worksite located at Wading River Hollow Rd/Middle Country Rd. in Middle Island, NY 11953.    South Ocean Custom Framing Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1092827, citation number 1, item number 1, group a, issued on 10/22/2015 and was affirmed as a final order on 11/10/2015, with respect to the same worksite located at the Meadows at Yaphank in Yaphank, NY 11980.      Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
