Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The  employer did not furnish employment and a place of employment which were free from recognized hazards that caused or was likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard while unloading a steel 2-yard trash container from a dump truck with a lift-gate:    a)    At the worksite, on or about 5/25/16:  An employee was exposed to a struck-by hazard that resulted in his death when he was unloading a steel 2-yard trash container from the deck of a truck with a lift-gate device.  The employee stood behind the truck and pushed against the container as it was lowered on the lift-gate.  The container was not balanced on the lift gate and fell from the lift-gate crushing the employee.
