29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). On or about June 3, 2016, at the trenching site located on US-169 Frontage road between 36th N and E46th St N in Tulsa, OK, no protective devices were in place to protect employees working in a trench that was more than 5 feet in depth, exposing employees to the hazard of being crushed by falling soil. McGuire Brothers Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 954712, citation number 1, item number 4, and was affirmed as a final order on March 7, 2014, with respect to a workplace hazard located at 1212 W. 4th Ave. Stillwater, OK 74074. McGuire Brothers Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1046012, citation number 1, item number 1, and was affirmed as a final order on April 28, 2015, with respect to a workplace hazard located at 121st and S. Orbana, Bixby, OK 74008.
