29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: On or about June 3, 2016, at an excavation site located on Highway 169 North, south of the 56th street exit in Tulsa, OK, employees were working in an excavation where a competent person did not classify the soil type in accordance appendix A. Employees were exposed to crushed by hazards. 29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation. On or about June 3, 2016, at an excavation site located on Highway 169 North, south of the 56th street exit in Tulsa, OK, employees were allowed to enter and work in a trench that had an accumulation of water in the trench floor, exposing employees to the hazard of being crushed by fall soil.

29 CFR 1926.1051(a): A stairway or ladder shall be provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided. On or about June 3, 2016, at an excavation site located on Highway 169 North, south of the 56th street exit in Tulsa, OK, employees were allowed to work in a trench more than 4 feet that had no ladder or other means of safe access/egress.
