29 CFR 1910.212(a)(1): Machine guarding was not provided to protect operators and other employees from hazards created by ingoing nip points, rotating parts, flying chips and sparks: (a)Macksteel Warehouse, Inc. @ 415 20th Ave. SE, Watertown, SD 57201: On and prior to June 1, 2016, the employer did not ensure that employees using the Northern Industrial Tools pneumatic angle grinders used with the appropriate guards during grinding operations. Approximately six pneumatic angle grinders were being operated without the manufacturers' guards in place. This condition exposed employees to flying chips and sparks.

29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger operating cycle(s): (a)Macksteel Warehouse, Inc. @ 415 20th Ave. SE, Watertown, SD 57201: On and prior to June 1, 2016, the employer did not ensure that the Uni-Hydro Ironworker Pro-80 shear was adequately guarded at the point of operation. Employees utilizing the shear were able to place their hand behind the yellow barrier guard positioned at the front of the shear. A gap of approximately 1.75 inches was present, allowing the operator to place their hand behind the physical guard to position bar stock before and during a cycle. This condition exposed employees to an amputation hazard in that hands and fingers were exposed to the ironworker's shearing blade.

29 CFR 1910.252(b)(2)(iii): Where the work permits, the welder should be enclosed in an individual booth painted with a finish of low reflectivity such as zinc oxide (an important factor for absorbing ultraviolet radiations) and lamp black, or shall be enclosed with noncombustible screens similarly painted. Booths and screens shall permit circulation of air at floor level. Workers or other persons adjacent to the welding areas shall be protected from the rays by noncombustible or flameproof screens or shields or shall be required to wear appropriate goggles. (a)Macksteel Warehouse, Inc. @ 415 20th Ave. SE, Watertown, SD 57201: On and prior to June 1, 2016, the employer did not ensure workers and other persons walking adjacent to the welding area, were protected from the infrared light by welding screens. Two welders were welding to construct steel bins near a main walkway used by employees within the area. The welding operation was not enclosed with screens to protect workers. This condition potentially exposes employees to injurious light radiation.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also included a hazardous chemicals list and methods to inform employees of the hazards of non-routine tasks: (a)Macksteel Warehouse, Inc. @ 415 20th Avenue SE, Watertown, SD 57201: On and prior to June 1, 2016, the employer did not develop a written hazard communication program which at least described how the criteria specified for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also included a hazardous chemicals list and methods used to inform employees of the hazards of non-routine tasks, had not been developed for employee exposures, such as but not limited, to the following: (1)Rustoleum Fabric and Vinyl spray - Aerosol which contains acetone, methyl ethyl ketone, methyl isobutyl ketone, propane, xylene, and ethylbenzene; and (2)Majic Rust Kill oil base gloss and oil base matte finish-which contains toluene, naptha, xyelene, ethyl benzene, propane, and butane.

(a)Macksteel Warehouse, Inc. @ 415 20th Avenue SE, Watertown, SD 57201: On and prior to June 1, 2016, the employer did not review with each employee upon initial assignment those parts of the emergency action plan which the employee must know to protect the employee in the event of an emergency, such as but not limited to the following: (1) Emergency escape procedures and emergency escape route assignments; (2) Procedures to be followed by employees who remain to operate critical plant operations before they evacuate; (3) Procedures to account for all employees after emergency evacuation has been completed; (4) Rescue and medical duties for those employees who are to perform them; (5) Names or regular job titles of persons or departments who can be contacted for further information or explanation of duties under the plan.

Employees operate shears, portable abrasive wheel grinders, and other tools and equipment in the facility. This condition exposed employees to hazards associated with these tools and equipment. Abatement Note: The employer shall verify that the required workplace hazard assessment has been performed through a written certification that shall include the following: (1) The workplace evaluated; (2) The person certifying that the evaluation had been performed; (3) The date(s) of the hazard assessment; and, (4) The document identified as a certification of the hazard assessment.
