OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s), in that the employees assisting the hydraulic excavator operator in maneuvering through a tight space were exposed to struck by hazards associated with the movement of an excavator. a) On June 3, 2016, the operator failed to ascertain whether it was safe to rotate the excavator before he rotated it. The use of additional communication devices would potentially have reduced the hazard in that situation. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to ensure that both the excavator and ground employee are in constant radio contact and using hand signals and visual confirmation to ensure safe movement of the excavator.
