29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  (a) Townhome, upper roof: On or about June 6, 2016, and at times prior, the employer exposed employees to struck-by hazards while using circular saws and pneumatic framing nail guns, in that protective eyewear was not provided to employees prior to using this equipment for framing and sheathing activities.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a)  Townhome, upper roof: On or about June 6, 2016, and at times prior, the employer exposed employees to fall hazards of 10 feet to the lower roof, in that a fall protection system was not provided to employees installing plywood sheathing on a 2/12 pitched roof.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) Townhome, first floor (garage): On or about June 6, 2016, and at times prior, the employer exposed employees to fall hazards of 12-feet, 10-inches to the lower concrete surface, in that the side rails of the ladder did not extend at least 3-feet past the second floor landing. The ladder used to access the upper level did not reach the second floor which exposed employees to fall hazards.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:  (a) New townhome construction, front side: On or about June 6, 2016, and at times prior, the employer failed to inspect all of the electrical cords prior to the start of the work shift, in that extension cords hard torn outer casings and damaged strain relief and were not removed from service.
